RESCUE Debtsgone is a true rescue company operating in the Small to Medium Enterprise Sector. What we do is work alongside directors to get through a very difficult and trying time to return their Company’s to profitability.

EXPERIENCED ADVISER'S
You will be assigned one of our experienced adviser's who will discuss everything with you. You will not just be passed around, you will be given your adviser’s direct telephone line and they will be your point of contact to answer any questions you may have.

WHAT WE DO We recognise that at this time there will be a considerable number of questions that may not always become apparent straight away. That is precisely why your adviser will be with you all the way through the decision process.

Our people, with you, look at the company’s circumstances, ask quite a lot of questions and decide with the director the way forward. It may be that you also need help personally because a considerable amount of directors actually use their own money to keep the company afloat. Do not despair, we can also provide a way forward for you should you need this.

Many directors get to a stage where they can not see a way out. They may have had numerous phone calls demanding money, letters before action, statutory demands, County Court Judgements sometimes even High Court Judgements. You may be at the stage where you are getting Solicitors letters, it is amazing that they always arrive on Saturday mornings when you can not contact anyone to talk about them. And what do you do? Worry all weekend until Monday when you can actually speak with a person. Do not let the situation get to the stage where you are only safe until the next phone call or knock on the door, it could be a Bailiff.

Remember if you owe money to someone there is only one thing certain and that is that they will want it back.

PETITIONS Possibly the worst thing that can happen to a limited company is having a Winding Up Petition lodged against it. This sets all manner of things in motion.

The first thing that can happen, and this is most likely, is that you will find your bank account frozen. If you decide to pay the debt to get the petition lifted don’t forget that if you owe other creditors they can attach to the petition. Therefore paying one won’t stop the others.

Having a petition is where the whole process can start costing money. Firstly if you want to keep the company you need to obtain an adjournment to give you time to plan your next move.

If you need to pay wages and there is money in the account you will need to get your account opened to gain access to the funds. Therefore you need to apply for a VALIDATION ORDER; this will unfreeze your account but only for nominated transactions such as wages. This will have to be done through a Solicitor so there will be a charge.

If the company is wound up by the Court and you want it back for whatever the reason, it may owe you money or you have big contracts about to start, you need to apply very quickly to have the company brought back to life. This can be done by applying for a RECISSION of the Winding Up Order. This again is done by an application to court through a Solicitor, also a costly exercise.

Remember these applications are at a Judges discretion so not guaranteed to succeed.

There is a further aspect to your company being wound up by the courts, there will be an investigation and if there is money owed to the Crown then there could be a ban on you acting as a director for up to fifteen years, accompanied with a fine.

We can organise all of the aforementioned, we do this as a matter of course during our daily work. As you can imagine we have to cope on a daily basis with all aspects of Insolvency. However, all of this will cost money so there is a lot to be said about talking to us early in the process so the whole process can be achieved with minimal expense.
